PRIVACY POLICY

This Privacy Policy (hereinafter referred to as the “Privacy Policy”) stipulates the handling of personal information under the custody of Ashinaga Ikueikai (hereinafter referred to as the “Corporation”).

1. Personal Information

The term “personal information” as used in this Privacy Policy shall mean information on a living individual as set forth in the Act on the Protection of Personal Information (hereinafter referred to as the “Act on the Protection of Personal Information”) (which means name, date of birth, and other information that can identify a specific individual), and attribute information concerning an individual, such as address, residence, e-mail address, telephone number, and other information that is used in conjunction with a specific individual.

2. Proper Acquisition of Personal Information

The Company shall acquire personal information by appropriate means and shall not acquire such information by deception or other wrongful means.

3. Notification or Publication of Purpose of Use

When acquiring personal information, the Corporation shall notify the person of the purpose of use or publicly announce the purpose of use in advance. Provided, however, that this shall not apply to the following cases:

  1. Cases in which notifying the person of the Purpose of Utilization or publicly announcing it are likely to harm the life, body, property, or other rights and interests of the person or a third party

5. Change of purpose of use

The Company will not change the Purpose of Use of Personal Information beyond the scope reasonably recognized as being reasonably related to the Purpose of Use before the change, and will notify or publicly announce the changed Purpose of Use.

6. Restriction on Use

The Corporation shall not handle personal information beyond the scope necessary for the achievement of the Purpose of Use without obtaining the prior consent of the Customer. Provided, however, that this shall not apply to the following cases:

  1. In accordance with laws and regulations
  2. When it is necessary for the protection of the life, body, or property of a person and it is difficult to obtain the consent of the person

  3. Cases in which it is particularly necessary for the improvement of public health or the promotion of the sound upbringing of children and in which it is difficult to obtain the consent of the person in question

  4. Cases in which it is necessary to cooperate with a state organ, a local government, or a person entrusted thereby in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person in question is likely to hinder the execution of the affairs in question

7. Handling of Personal Information Requiring Consideration

In the event the Corporation obtains Personal Information for Consideration (which means personal information including race, creed, social status, medical history, history of crime, fact of harm caused by crime, and other descriptions specified by a Cabinet Order as requiring special consideration for the handling of such information so as not to cause unjust discrimination, prejudice, or other disadvantages to the principal) or provides such information to a third party, the Corporation shall obtain the consent of the Principal in advance, except in exceptional cases provided for by laws and regulations.

8. Handling of anonymized processing information

In the event the Company prepares anonymized processing information (which means information that is processed so that the personal information cannot be identified and that the personal information cannot be restored), the Company shall publicly announce the items of personal information included in the anonymized processing information. In addition, when the anonymized processing information is provided to a third party, the items of personal information included in the anonymized processing information to be provided to a third party and the method of provision thereof shall be announced in advance, and it shall be clearly indicated that the information provided is anonymized processing information.

9. Safety management

The Corporation shall conduct necessary and appropriate supervision of the members and employees of the Corporation in order to prevent the leakage, loss, or damage of personal data (which means personal information constituting the Personal Information Database, etc. stipulated in the Personal Information Protection Law, and the same shall apply hereinafter) and to ensure the safety management of personal data.

10. Supervision of Trustees

In the event that the handling of personal data is entrusted in whole or in part, the Corporation shall conclude an agreement including confidentiality with the entrusted party, or request the entrusted party to agree on the terms and conditions stipulated by the Corporation, and conduct necessary and appropriate supervision so that the entrusted party can safely manage personal data.

11. Restriction of Provision to A Third Party

The Corporation shall not provide personal data to any third party without obtaining the prior consent of the principal except in the following cases: Provided, however, that this shall not apply to the following cases:

  1. In accordance with laws and regulations
  2. When it is necessary for the protection of the life, body, or property of a person and it is difficult to obtain the consent of the person

  3. Cases in which it is particularly necessary for the improvement of public health or the promotion of the sound upbringing of children and in which it is difficult to obtain the consent of the person in question

In the event the Personal Information Protection Committee notifies the Personal Information Protection Committee of the items, means, and method of providing the Personal Data to be provided to a third party, the fact that the provision of the Personal Data to a third party will be suspended at the request of the Person, and the method thereof, including the provision to a third party for the Purpose of Use in advance; and in the event the Personal Information Protection Committee has notified the Personal Information Protection Committee of such matters in advance.
  6. In the following cases and other cases where the recipient of personal information does not fall under the category of “third party”
    
 (1)Where the Corporation entrusts the handling of Personal Information in whole or in part to the extent necessary for the achievement of the Purpose of Utilization

    
 (2)Cases where business is succeeded due to merger, spin-off, transfer of business, etc.

12. Disclosure of Personal Information

When requested by the Customer to disclose personal information, the Company shall disclose such personal information to the Customer without delay. Provided, however, that the Company may not disclose all or part of the information in the event of any of the following due to disclosure. In addition, in the event the Company decides not to disclose such information, the Company shall notify the employee thereof without delay. Please note that information other than personal information such as access logs shall not be disclosed in principle.

  1. Cases in which disclosure is likely to harm the life, body, property, or other rights or interests of the person or a third party
  2. Cases where there is a risk of causing a serious hindrance to the proper implementation of the business of the Corporation.

13. Correction of Personal Information, etc.

In the event the Company is requested by the Customer to correct, add, or delete the contents of personal information (hereinafter referred to as “Correction, etc.”) on the grounds that the Personal Information is not true, the Company shall conduct necessary investigations within the scope necessary for the achievement of the Purpose of Use without delay, correct the contents of personal information, etc. based on the results thereof, and notify the Customer thereof. If you wish to correct the contents, please contact the Customer Support Office at a later time. Provided, however, that this shall not apply where special procedures have been established pursuant to the provisions of laws and regulations.

14. Suspension of Use of Personal Information, etc.

In the event the Company is requested by the Customer to suspend or delete the use of Personal Information (hereinafter referred to as “Suspension of Use”) on the grounds that Personal Information is notified to the Customer or is handled beyond the scope of the Purpose of Use previously announced or is obtained by deception or other wrongful means, the Company shall conduct necessary investigations without delay and take measures such as suspending the use of Personal Information based on the results of such investigations, and shall notify the Customer thereof. If you wish to suspend the use of such Personal Information, please contact the contact point listed below. Provided, however, that in the event that there is a large amount of cost for the suspension of use of personal information, or in the event that it is difficult to suspend the use of personal information, etc., any substitute measures necessary to protect the rights and interests of the person in question may be taken, such substitute measures shall be taken.

15. Publication of Matters Concerning Retained Personal Data

The matters to be publicized concerning the retained personal data handled by the Corporation (meaning personal data that the Corporation is authorized to disclose, correct, etc., discontinue use, etc., and discontinue the provision to a third party, and that is not specified by a Cabinet Order as harming the public interest or other interests by making it clear whether such data exists or not, or that is to be deleted within a period of not more than one year as specified by a Cabinet Order, and the same shall apply hereinafter) are as follows:

In the event the Company decides not to respond, the Company shall notify the Employee thereof without delay.
  4. Procedures for disclosure, correction, suspension of use, etc. The same shall apply to procedures for disclosure, correction, etc., and suspension of use, etc. of personal information.
  5. The same shall apply to inquiries about retained personal data and inquiries about personal information to whom complaints about retained personal data are filed.
